1. Eligibility. Murdoch’s Colorado Farm Show Giveaway (the “Sweepstakes”) is open to legal residents of the fifty (50) United States and the District of Columbia who are at least 18 years of age. The following are ineligible to participate in the Sweepstakes: Sponsor’s employees and employees’ immediate family members (spouse, parents, siblings, and children); household members of said employees and their immediate family members (whether related or not); Sponsor’s subsidiaries and affiliates and their advertising and promotion agencies and their employees; individuals engaged in the development, production, or distribution of materials for the Sweepstakes.

2. Sponsor. Ranch and Home Supply, LLC, dba Murdoch’s Ranch & Home Supply, 2311 North 7th Ave., Bozeman, MT 59715.

3. Promotion Description/Promotion Period. The Sweepstakes is an “enter for a chance to win” Sweepstakes conducted via text entry and mail-in entry.

   The Sweepstakes begins on Tuesday, January 28, 2020 at 6:00:01 AM Mountain Time (“MT”), and ends on Thursday, January 30, 2020 at 7:59:59 PM (MT) (the “Promotion Period”). Entries submitted outside of the Promotion Period are void. During the Promotion Period, there are three (3) Daily Entry Periods as described below:

During the Promotion Period, eligible entrants may enter Sweepstakes for a chance to win one of the three (3) available Daily prizes.

4. Limit on Entries & How to Enter. LIMIT ONE (1) ENTRY AND ONE (1) PRIZE, PER PERSON, PER PHONE NUMBER, PER EMAIL ADDRESS, PER DAILY ENTRY PERIOD DURING THE PROMOTION PERIOD. ENTRIES OVER THESE LIMITS ARE VOID. ALL ENTRIES ARE SPONSOR’S PROPERTY.
   
   There are two (2) ways to enter the Sweepstakes: (A) via text message, or (B) via mail-in entry.

1. Text Message Entry. Eligible participants may enter via cellular phone by texting to 71441 the key word found at displays and advertisements at the Colorado Farm Show event (the “Text Entry”). A return text message will be sent to the eligible participant containing a link to the promotional website. To complete the Text Entry, the eligible participant must then complete the registration information as directed to be entered into the applicable Daily Entry Period.

2. Mail-In Entry. To enter without sending a text message, eligible participants may request one (1) Sweepstakes play for each of the three (3) Daily Entry Periods by: (a) placing your name, complete mailing address, phone number, date of birth, and email address (if available) on a 3” x 5” piece of paper (the “Paper Entry”); (b) inserting the Paper Entry into a #10 envelope with sufficient prepaid postage or stamp and mailing it to “Murdoch’s Colorado Farm Show Sweepstakes Play Request” at PO Box 11508, Bozeman, MT 59719-1508 (the “Mailed Entry”); (c) ensuring that the Mailed Entry is postmarked by January 30, 2020 and received by February 7, 2020. Sponsor is not responsible for lost, late, stolen, misdirected, incomplete, illegible, damaged, or postage-due Mailed Entries.

5. More on Text Message Entry. To enter via Text Entry, you must be a wireless service subscriber with two-way text messaging functionality on an enabled cellular phone. Participation in this Sweepstakes via Text Entry might not be available through all wireless carriers. Please note that your cellular service provider may charge you standard text messaging charges for each Text Entry you send and any text messages you might receive on your cellular phone in connection with this Sweepstakes. Please consult your cellular service provider regarding their pricing plans. Check your phone capabilities for specific instructions.

6. Random Sweepstakes Drawing / Prizes / Approximate Retail Values (“ARV”) / Odds. Each random Sweepstakes drawing will be conducted by an independent sweepstakes administrator (the “Administrator”) as described below:

   All decisions of Sponsor and/or the Administrator shall be final and binding in all respects. Odds of winning any of the available prizes depends upon the total number of eligible entries received for the applicable Daily Entry Period. There are a total of three (3) available prizes to be won in the Sweepstakes. Murdoch’s gift card prizes are subject to the terms and conditions available at www.murdochs.com.

7. Prize Winner Notification Verification. All potential winners are subject to verification before the applicable prize will be awarded. Potential prize winners will be notified by email and/or phone call within one (1) hour of the applicable random drawing and must reply within two (2) hours by providing Sponsor’s representative with the information necessary to verify his/her eligibility (“Verification”). If this Verification is not made, the potential prize winner will be disqualified from the Sweepstakes and an alternate prize winner may be selected. In the event that a potential prize winner is disqualified for any reason, an alternate winner will be selected in a random drawing from all eligible entries received during the applicable Daily Entry Period and for the applicable prize. Sponsor, in its sole discretion, may attempt to contact up to three (3) potential winners of each prize in accordance with the immediately foregoing procedure, after which the prize in question may go unawarded if it remains unclaimed according to these Official Rules.

8. Conditions of Participation & Certain Restrictions. The participant is solely responsible for entering the Sweepstakes during any and all Daily Entry Periods and providing the required Verification if selected as a potential prize winner. Taxes on any prize are the sole responsibility of the winner. No cash equivalents, prize substitutions, or prize transfers are permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value, solely at the Sponsor’s discretion. Acceptance of a prize constitutes the winner’s permission for the Sponsor to use winner's name and city/state of residence purposes of Sponsor’s advertising and promotion without compensation to winner, unless prohibited by law. All entries become the property of Sponsor and will not be acknowledged or returned. By entering, participants acknowledge and agree to comply with all terms and conditions of these Official Rules, including all eligibility requirements.

9. Contingency of Sweepstakes. If for any reason beyond the control of the Sponsor or its Administrator (including, without limitation, computer virus, unauthorized access, tampering, fraud, and technical failures) that affects the proper and planned administration, security, fairness, integrity, and/or conduct of the Sweepstakes, the Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes and to award the available prizes via a random drawing from among all valid and eligible entries received up to the point of the Sponsor’s decision.

10. Limitation of Liability & Indemnification. By participating in the Sweepstakes, participants agree to be bound by the Official Rules and the decisions of the Sponsor and its Administrator, which are final and binding in all respects. By participating in the Sweepstakes, participants acknowledge and agree that Sponsor is not responsible for any of the following (listed for emphasis, not limitation): typographical or other error in the printing of the offer or in administration of the Sweepstakes; lost, late, or illegible entries; electronic transmission errors resulting in omission, interruption, deletion, defect, or delay in operations or transmission; theft, destruction, unauthorized access to, or alterations of entry materials; technical, network, telephone equipment, electronic, computer, hardware, or software malfunctions or limitations of any kind; inaccurate transmissions of entry information or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof.
    
    PLEASE READ CAREFULLY. THE FOLLOWING TERMS LIMIT SPONSOR’S LEGAL LIABILITY AND PROVIDE THAT PARTICIPANTS SHALL INDEMNIFY SPONSOR UNDER CERTAIN CONDITIONS.
    
    TO THE EXTENT PERMITTED BY LAW, SPONSOR AND ITS SUBSIDIARIES AND AFFILIATES, AND ALL OF THEIR OWNERS, OFFICERS, MANAGERS, EMPLOYEES, AND AGENTS (“SPONSOR AND ASSOCIATES”) SHALL NOT BE LIABLE (STRICTLY, VICARIOUSLY, JOINTLY AND SEVERALLY, AS PART OF A CLASS, OR OTHERWISE), IN ANY ACTION (CONTRACT, TORT, OR OTHER), ON ANY BASIS (BREACH, NEGLIGENCE, OR OTHER CULPABLE ACT OR OMISSION), FOR ANY INJURY, HARM, DAMAGES, OR OTHER LOSS (INCLUDING, WITHOUT LIMITATION, DAMAGE TO ANY EQUIPMENT OR PHONE AND LOSS OF PRIVACY, PUBLICITY RIGHTS, OR REPUTATION), COMPENSATED BY ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, OR MULTIPLIED DAMAGES, FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SWEEPSTAKES OR ANY ASPECT OF OR PARTICIPATION IN THE SWEEPSTAKES. UNDER NO CIRCUMSTANCES SHALL ANY PARTICIPANT BE ENTITLED TO ANY RELIEF (INCLUDING ATTORNEY FEES AND COURT COSTS) OTHER THAN DAMAGES FOR OUT-OF-POCKET EXPENSES UP TO TWO HUNDRED FIFTY DOLLARS ($250).
    
    The limitations of liability, responsibility, and damages stated above shall apply regardless of whether Sponsor and Associates knew, should have known, or had actual or constructive notice of any problems, issues, violations, injuries, harm, or damages.
    
    EACH PARTICIPANT IN THE SWEEPSTAKES SHALL INDEMNIFY, DEFEND, AND HOLD HARMLESS SPONSOR AND ASSOCIATES AGAINST ANY AND ALL CLAIMS, LIABILITIES, COSTS, EXPENSES, DAMAGES, AND OTHER LOSSES (INCLUDING REASONABLE ATTORNEY FEES AND COURT COSTS) ARISING OUT OF OR RELATED TO THE SWEEPSTAKES OR ANY ASPECT OF OR PARTICIPATION IN THE SWEEPSTAKES. IN SUCH CASE, PARTICIPANT SHALL NOT SETTLE OR OTHERWISE COMPROMISE ANY CLAIM ARISING OUT OF OR RELATED TO THE SWEEPSTAKES OR ANY ASPECT OF OR PARTICIPATION IN THE SWEEPSTAKES WITHOUT SPONSOR’S PRIOR WRITTEN CONSENT.
    
    Caution: Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent of the law.

11. Severability. If for any reason a court of competent jurisdiction finds any provision of these Official Rules, or portion thereof, to be unenforceable, such provision/portion will be enforced to the maximum extent permissible and the remainder of these Official Rules will continue in full force and effect.

12. Governing Law & Forum. These Official Rules shall be governed by and interpreted in accordance with the laws of the State of Montana, without regard to choice of law or conflict of law principles. Any suit or proceeding brought in connection with the Sweepstakes or any aspect of or participation in the Sweepstakes shall be brought in state court located in Gallatin County or federal court located in Billings, Montana. The parties to any such suit or proceeding shall submit to the exclusive jurisdiction of such courts and waive any and all objections based on jurisdiction, venue, or inconvenient forum.

13. Entire Agreement. The Official Rules constitute the entire agreement between Sponsor and any and all Sweepstakes participants with respect to all aspects of the Sweepstakes. The Official Rules supersede and cancel any and all prior and contemporaneous negotiations, agreements, and understandings (oral and written) with respect to the Sweepstakes.

15. Winner’s List. To receive the name and city/state of residence of Sweepstakes prize winners, mail a stamped, self-addressed envelope accompanied with a signed, hand-printed request to “Murdoch’s Colorado Farm Show Sweepstakes Winner’s List,” PO Box 11507, Bozeman, MT 59719-1507. All requests must be received by March 15, 2020.
